1. Acceptance of Terms

These Terms and Conditions ("Terms") apply to all visitors, users, and customers of the Sandra van Doorn Atelier website (the "Site"). By accessing or using any part of the Site, including browsing, registering an account (if applicable), or making a purchase, you agree to be bound by these Terms.

We reserve the right to update or modify these Terms at any time. We will post the revised version on the Site with the new "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must stop using the Site immediately. Significant changes may also be notified via email to registered users where feasible.

2. Products, Descriptions and Availability

We strive to ensure that all product descriptions, images, prices, and other details on the Site are accurate. However, minor variations in size, colour, texture, or availability may occur, particularly with handmade or original artworks. Artwork colours may appear differently depending on your screen settings and device.

All products are subject to availability. We reserve the right to discontinue or change products without notice.

All artwork, illustrations, photographs of artworks, text, and other content on the Site are the sole property of Sandra van Doorn and protected by copyright.

3. Pricing and Payment

All prices are listed in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice.

Payment is required in full at the time of purchase. We accept the following payment methods: bank transfer and all major Credit cards via Oxford St Gallery. In the event of a payment failure or dispute, we reserve the right to cancel the order.

Obvious pricing errors (e.g., typographical mistakes) may result in cancellation of the affected order(s), with notification to the customer.

4. Shipping and Delivery

We offer domestic (Australia) and international shipping. Delivery timeframes are estimates only and may vary based on your location, the shipping method selected, and product type. Delays can occur due to factors beyond our control.

Risk of loss or damage passes to you upon dispatch from our premises or gallery representatives. We are not responsible for customs duties, import taxes, or delays caused by international postal or courier services. International buyers are responsible for any additional charges imposed by their local authorities.

Tracking information will be provided where available.

5. Returns, Refunds and Cancellations

All sales are final except in the following cases:

The item arrives damaged or defective; or

There is an error on our part (e.g., incorrect item shipped).

Process for damaged/defective items: Contact us within 7 days of delivery with clear photographs of the damage, the packaging, and the shipping label. We will assess the claim and, if approved, arrange a replacement or refund (including reasonable return shipping costs where applicable).

All sales are final. Change-of-mind returns are not accepted due to the unique and personal nature of artworks. This policy does not affect your rights under the Australian Consumer Law, which provides non-excludable guarantees for goods of acceptable quality and fitness for purpose.

6. Copyright, Intellectual Property and Licensing

All artwork, illustrations, text, images, photographs of artworks, designs, and other content displayed on or available through the Site are the sole intellectual property of Sandra van Doorn and are protected under Australian and international copyright, trademark, and other intellectual property laws.

Ownership: Purchasing a physical artwork, limited edition print, or any other product does not transfer copyright or any reproduction rights. Sandra van Doorn retains all rights in the underlying artwork.

Prohibited Uses (without prior written permission):

Copying, downloading, screenshotting, saving, reproducing, distributing, or publicly displaying any artwork or images from the Site.

Using images of artworks on social media, websites, marketing materials, or any other platform without proper credit and explicit permission.

Altering, manipulating, creating derivative works, or using the artwork in any commercial context (e.g., on textiles, stationery, advertising, merchandise, or for resale/licensing).

Removing signatures, watermarks, or copyright notices.

Using any content for AI training, data mining, or similar purposes.

Personal Use: You may display purchased artworks in your home or workplace. You may share photographs of your own purchased physical pieces on social media or personal platforms for non-commercial enjoyment, provided you give clear credit to Sandra van Doorn (e.g., tagging @sandravandoornatelier and linking to www.sandravandoorn.art). Do not misrepresent the work as your own or use it in any way that could harm the artist’s reputation.

Licensing Requests: For any commercial, editorial, publication, collaborative, or other licensing use, please contact hello@sandravandoorn.art. Licensing is granted on a case-by-case basis and subject to a separate agreement.

Moral Rights: Sandra van Doorn asserts her moral rights in all works, including the right of attribution and the right to prevent derogatory treatment.

Any unauthorised use may result in legal action.

7. User Conduct and Website Use

You agree not to:

Use the Site for any unlawful purpose or in violation of any applicable laws.

Attempt to gain unauthorised access to any part of the Site, accounts, or systems.

Engage in scraping, data mining, or automated extraction of content.

Upload or transmit viruses, malware, or harmful code.

Harass, defame, or interfere with other users.

We reserve the right to terminate or suspend your access to the Site at our discretion, without notice, for any breach of these Terms.

8. Privacy

Your privacy is important to us. We handle personal information in accordance with our separate Privacy Policy [insert link] and the Australian Privacy Principles. Personal data is collected primarily for order processing, customer communication, shipping, and (where you opt in) marketing.

9. Limitation of Liability and Disclaimers

To the fullest extent permitted by law, including under the Australian Consumer Law, Sandra van Doorn Atelier and its owner are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any products purchased.

This includes (but is not limited to) loss of profits, data, goodwill, or business opportunities. Our total liability to you for any claim shall not exceed the amount paid by you for the relevant product(s).

We do not guarantee uninterrupted or error-free access to the Site. All content is provided "as is" without warranties of any kind, except those non-excludable under law.

10. Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including (but not limited to) acts of God, war, strikes, pandemics, government orders, supply chain disruptions, or natural disasters.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Western Australia, Australia. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Western Australia.

You agree to attempt good-faith resolution of any dispute with us before initiating legal proceedings.
